This is an appeal of a Thurston County Superior Court order granting the cross motion of Respondents Washington State Department of Ecology, et al. to dismiss with prejudice the action by Appellants Dioxin/ Organochlorine Center, et al. which sought a declaratory judgment that respondents' national pollutant discharge elimination system permit process, as applied to certain permit applicants, violates the State Environmental Policy Act of 1971. Appellants also appeal the court's order allowing the Northwest Pulp and Paper Association to intervene in the declaratory judgment action. We granted…
