This appeal concerns whether a right of way exists as claimed by the defendants, Jacob Soffer and Joseph Soffer, across land owned by the plaintiffs. The plaintiffs brought an action in three counts seeking, inter alia: (1) a declaratory judgment determining whether the defendants had a right of way over the plaintiffs’ property and, if so, defining its scope; (2) an injunction against the defendants’ use of the claimed right of way and damages for past use; and (3) a judgment quieting title in the plaintiffs.
