OPINION

ANDEWELT, Judge.

In this military pay action, plaintiff, Lieutenant James G. Law, United States Coast Guard (Coast Guard), in effect seeks an order from this court either declaring that plaintiff was promoted to the rank of lieutenant commander on June 1, 1990, by operation of law, or, in the alternative, directing defendant to grant plaintiff a retroactive promotion to that rank as of that date. Plaintiff also seeks other related relief including attendant backpay, i.e., the difference between the pay of a lieutenant and the pay of a lieutenant commander. This action is presently…
