SOPER, District Judge.
The bill of complaint in this case was filed on August 31, 1928, by the Fleisehmann Yeast Company, for which Standard Brands, Incorporated, was subsequently susbtituted as complainant. The bill charged the Federal Yeast Corporation, the defendant, with infringement of United States letters patent Nos. 1,449,102, 1,449,105, and 1,449,106, and prayed for an injunction against continuance of the infringement and for an accounting for damages and profits.
