Affirming.

This- is the second appeal- of this' case. The opinion on the former appeal will be found in 145 Ky., 516, and as •the facts as to how the accident occurred are very fully set out in that opinion, it does not seem necessary to repeat them here.

On the first trial the railway company declined to in~ 'troduee any evidence, but- on the trial from which this appeal is prosecuted, it introduced the engineer and fireman of the engine that struck appellee, and several other witnesses, and the jury, after hearing the evidence, assessed the damages in favor…
