Affirming.

On April 2, 1915, appellee and plaintiff, Forest Sanders, a colored man, was living with his family consisting of a wife and several small children .in the second story of a building located on Central Avenue, in the city of Newport, Kentucky. Between twelve and one o’clock on the night of that day the appellant, Frank Morton (defendant below), who was a policeman in that city, with another officer went into the residence of plaintiff where he and his wife and children were asleep, threw a flashlight into his face, as well as a pistol, and arrested…
