Appellant, James Foster Kane, was convicted of one count of misdemeanor Driving Under the Influence of Alcohol (hereinafter DUI) (47 O.S.Supp.1993, § 11-902) in a non-jury trial in the District Court of Rogers County, Case No. CM-94-272, the Honorable David Allen Box, Special Judge, presiding.
