Plaintiff WorldHomeCenter.com, Inc. (“WorldHomeCenter”) is an online retailer of home improvement products incorporated in New York. (Am. Compl. ¶¶ 4, 6.) Defendant PLC Lighting, Inc. (“PLC”) is a manufacturer and seller of lighting fixtures and accessories incorporated in Delaware. (Id. ¶¶ 5, 7.) Plaintiff commenced this action by filing a Complaint in New York Supreme Court, New York County, on April 12, 2010, alleging violations of the New York Deceptive Trade Practices Act and Donnelly Act and seeking declaratory and injunctive relief.…
