This is an appeal from an order of the Court of Common Pleas of Lackawanna County making absolute a rule to open judgment entered on a note signed by Luther Tonkin and Irene Lance Tonkin, his wife.

The defendant, Mrs. Tonkin, filed a petition to open judgment on December 15, 1937. Pursuant to stipulation on behalf of the parties, depositions were taken in support of, as well as in opposition to, the petition.
