MEMORANDUM OPINION

ANDRE M. DAVIS, District Judge.

This is a civil rights action instituted pursuant to 42 U.S.C. § 1983 by a police official who principally contends that he was the victim of unlawful retaliation in violation of his rights under the First Amendment. 1 Now pending is defendants’ motion to dismiss the federal claims pursuant to Fed.R.Civ.P. 12(b)(6). 2 The filing of the motion to dismiss was prompted by the Supreme Court’s decision last term in Garceta v.
