Banco Bilbao Vizcaya-Puerto Rico v. United States
United States Court of Federal Claims
1Opinion of the Court
OPINION
FIRESTONE, Judge.
This case comes before the court on defendant’s motion for summary judgment. The issue to be decided is whether the government is bound by an alleged assignment of contract rights in favor of plaintiff, Banco Bilbao Vizcaya — Puerto Rico (“BBV”). The undisputed facts of this case establish that plaintiff: (1) failed to secure a valid assign*30ment of the subject contract under the Anti-Assignment Act (“the Act”); and, (2) cannot show that the government waived compliance with the Act. Therefore, the court GRANTS defendant’s motion for summary judgment.
