LOZANO, District Judge.
This matter is before the Court on Defendant, James Oberweis’ (“Oberweis”), Motion to Dismiss, filed on October 7,1992. For the reasons set forth below, Oberweis’ Motion is DENIED IN PART and GRANTED IN PART.
BACKGROUND
Jack Schwartz (“Schwartz”) is the Trustee of the Schwartz Medical Group Employee Pension Plan (the “Plan”) and, as such, has investment discretion to control the assets of the Plan.
