MEMORANDUM ORDER

LEE, District Judge.

THIS matter is before the Court on Defendants Donald Rumsfeld and others’ Motion to Dismiss and for Summary Judgment. Plaintiff Dr. Elizabeth Frothing-ham Lammers was denied her claim for a military pension survivor benefit annuity, and she is suing the defendants, various United States Army officials, in their official capacities, for violations of her Due Process rights under the Fourth and Fifteenth Amendments of the United States Constitution and the Administrative Procedure Act for their failure to provide payments to her under the statutory Survivor…
