MEMORANDUM AND ORDER
THEIS, District Judge.
This matter is before the court on a motion for summary judgment by the garnishee, Hawkeye Security Insurance Company (“Hawkeye”) (Doc. 56). This case involves an accident which occurred on November 2, 1987 in Finney County, Kansas. A tractor-trailer driven by plaintiff Daniel J. Wallen and owned by plaintiff Wallen and Sons, Inc. was involved in a collision with a 1979 Chevrolet Impala. station wagon driven by defendant Sonya Marie Acosta (“Sonya”), who was thirteen years old at the time, and owned by defendant Rosall Acosta, Sonya’s father.…
