WOLFE, Justice.

This is an appeal from a judgment of nonsuit and dismissal rendered by the district court of Utah county in the case based upon the rejection of an application — No. A-1171 —requesting the permission to change the place and nature of use of a decreed water right on Provo river. The facts in detail are as follows: Mrs. Esthma Tanner, the plaintiff, on the 28th day of August, 1931, filed her application for a change in the point of diversion, place, and nature of the use of certain waters comprising a part of the Provo river system claimed to belong to her by reason of paragraph…
