SANBORN, Circuit Judge.

This appeal is from a judgment for the plaintiff (appellee) in a suit upon a policy of war risk insurance issued to Winston Arthur Cameron. The insured commenced the suit in November, 1930. It was based upon a claim that he had become totally and permanently disabled before his policy lapsed. This the Government denied. A trial resulted in a verdict and judgment for the insured, which, on appeal, this Court reversed upon the ground that the evidence was insufficient to support the verdict. United States v.
