Plaintiff FPL Group, Inc. (“FPL Group”) has brought this action against the Internal Revenue Service (“IRS,” “the Service,” or “the agency”) under the Freedom of Information Act (“FOIA”), 5 U.S.C. § 552, and the Internal Revenue Code (“IRC”), 26 U.S.C. § 6110. FPL Group seeks to compel disclosure of IRS documents related to determinations regarding its ability to take certain deductions on the consolidated tax returns that it filed on behalf of its subsidiary corporations.
