This case is before the Court on remand from the Court of Appeals. The Court is tasked with deciding, consistent with the guidance from the D.C. Circuit, whether certain documents created by Boehringer Ingelheim Pharmaceuticals, Inc. and subpoenaed by the Federal Trade Commission are protected by either the work-product doctrine, the attorney-client privilege, or both.
