DUFFY, Senior Circuit Judge.
This is a diversity suit brought to recover damages for injuries suffered by plaintiff, a school boy, when, it is alleged, defendant’s bakery truck, while turning at a street intersection, and while being driven at a high rate of speed, mounted a street curb and struck the nine-year old plaintiff who was standing on the walk at the street intersection.
In Count 1 of the complaint it is alleged that by reason of being struck by the rapidly moving truck owned and operated by defendant, the plaintiff boy suffered injuries which proof later showed to be principally a…
