—Order, Supreme Court, New York County (Ira Gammerman, J.), entered on or about March 31, 1999, which granted defendants’ motion for summary judgment dismissing plaintiffs’ second, ninth, tenth and eleventh causes of action and denied plaintiffs’ cross-motion for partial summary judgment, unanimously modified, on the law, to deny defendants’ motion and reinstate the *180above-mentioned causes of action, and otherwise affirmed, without costs.
