The Plaintiff, BC Liquidating, LLC (“Plaintiff’ or “BC Liquidating”), is a limited liability company established by the Lenders’ Third Amended Plan of Liquidation (“Plan”) for the Debtor, BC Funding, LLC (“BCF”), confirmed by Order, dated January 22, 2013 (“Confirmation Order”).
