RAMSEY, Judge.
In this case appellant was indicted in the District Court of Rains County on January 1, 1907, charged with the offense of murder. The case was called for trial in the following December in the same county and resulted in a conviction of murder in the second degree with appellant’s punishment assessed at confinement in the penitentiary for a term of five jrears.
