Appellant was convicted of murder in the second 'degree, and his punishment assessed at confinement in the penitentiary for a term of twenty-five years; hence this appeal.
The homicide occurred on the night of the 24th of January, 1904, in the city of Sherman, Grayson County. Deceased, Robert Francis, was employed as bookkeeper at the Grayson County Oil Mill, and on the particular Sunday night was at the office attending to some business.
