Appeal from the District Court of McLennan. Tried below before Hon. Sam E. Scott. Appeal from a conviction of murder in the second degree; penalty, twenty-five years imprisonment in the penitentiary. The opinion states the case.

Appellant was convicted of murder in the second degree, and his punishment assessed at confinement in the penitentiary for a term of twenty-five years; hence this appeal.
A branch of this case to wit: Catherine Smith v. State,46 Tex. Crim. 267; 10 Texas Ct. Rep., 984, was before this court at a former term. The facts on that trial were in a general way the same as on the present trial. Since then, the venue has been removed to McLennan County, and the appeal was prosecuted from a conviction in that county. The facts show that T.E.
