Background
On August 7, 2003 (the “Petition Date”), Ronald Edward Fonke (the “Debtor”) filed his chapter 13 case. At that time, there was a pending state court lawsuit styled AAR Incorporated v. Ronald Fonke, case no. 2001-52828, pending in Harris County District Court (the “State Court Litigation”). All discovery in the State Court Litigation was complete and the case was ready to proceed to trial. The lawsuit involved a contract between AAR Incorporated (“AAR”) and Third Coast Services, Inc.
