This case raises interesting questions regarding the distinction between the good faith standard for filing a Chapter 13 petition and the good faith standard for the confirmation of a Chapter 13 bankruptcy plan. The debtor in this case, Robert John Love, filed a petition for relief under Chapter 13 of the Bankruptcy Code. The bankruptcy court determined that Love did not file the bankruptcy petition in good faith.
