MEMORANDUM OPINION
ELLIS, District Judge.
In this breach of contract action against a German corporation, plaintiff has twice elected not to effect service of process via the Hague Convention, 1 choosing instead to serve, in the first instance, the Clerk of the Virginia State Corporation Commission, and in the second instance, defendant’s lawyer and registered agent for its wholly-owned subsidiary. For the reasons that follow, service in both instances is insufficient.
