Appeal from a judgment of the superior court for King county, Erater, J., entered January 19, 1916, upon findings in favor of the plaintiff, in an action to quiet title, tried to the court.

This action is to quiet title to a certain tract of land situated in King county. After a trial before the court without a jury, findings and judgment in conformity with the prayer for relief were entered, from which this appeal is taken. The material facts, as found by the court, are briefly these: Prior to November 21, 1914, N. B. Beck *209and wife were the owners of the premises in controversy, subject to a mortgage held by respondent upon which there was still due the sum of $2,800. As N. B.
