Robert Waterhouse has sued R.J. Reynolds Tobacco Company and Brown & Williamson Tobacco Corporation, cigarette manufacturers, for injuries he allegedly sustained in using their products. 1 The suit proceeds in several counts: Count I (Negligence), Count II (Strict Liability), Count III (False Representation), Count IV (Deceit/Fraudulent Concealment), Count V (Civil Conspiracy), Count VI (Breach of Express Warranty), Count IX (there are no Counts VII and VIII) (False and Misleading Advertising) and Count X (Punitive Damages).
