On May 5, 2006, Defendant Philip Morris USA, Inc. (“Philip Morris”) filed a Motion for Summary Judgment Based on Federal Preemption under FCLAA’s Express Preemption Provision, 15 U.S.C. § 1334(b), (Doc.
