MEMORANDUM OPINION AND ORDER

This matter comes before the court on Defendant’s Motion to Dismiss Plaintiffs Complaint (“Motion to Dismiss”), pursuant to Federal Rule of Civil Procedure 12(b)(6). Plaintiff, Whitney Lester, originally filed his Complaint in the Circuit Court of the City of Norfolk, Virginia, on July 9, 2012. Defendant TMG, Inc. (“TMG”) removed the action to this court on July 30, 2012, pursuant to 28 U.S.C. § 1446.
