ORDER
SCOTT, District Judge.
This matter comes before the Court on Defendant Washington Mutual Bank, F.A’s (WMB) Motion to Dismiss Com plaint (d/e 11) for failure to state a claim upon which relief can be granted, pursuant to Fed.R.Civ.P. 12(b)(6). Plaintiff James J. Diesi’s (Diesi) Complaint against WMB alleges violations of the Fair Debt Collection Practices Act (FDCPA), and claims statutory damages, as well as costs and fees. Diesi does not oppose WMB’s Motion. 1 For the reasons stated below, WMB’s Motion to Dismiss is ALLOWED.
