This matter comes before the court on Defendants Mutual Hospital Service, Inc.’s (“Mutual Hospital”) and John Doe’s (“Doe”) Motion to Dismiss, pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure.
