The defendant, a real estate broker, was employed by the plaintiff to procure a customer for his real estate. The defendant received an offer from one Scott, who was ready, able and willing to buy. Scott signed a written agreement to buy at the price of $10,000 and deposited $300. We infer that the plaintiff was willing to sell at the price of $10,000. The defendant then fraudulently represented to the plaintiff that Scott would pay no more than $9,700, and induced the plaintiff to sign an agreement to sell the property to one Sones, falsely representing to the plaintiff, that Sones was the…
