This is an action on the case under the survival act, brought by the administrator of the estate of Roy Lamb, deceased, against the township of Clam Lake, to recover damages for the death of the decedent, caused by injuries received on an alleged defective highway in said township.

Roy Lamb, who was 26 years of age, left the village of Tustin on February 18, 1909, about noon, to go north to the city of Cadillac to get a load of telephone poles. He drove a team of horses hitched to a set of Belknap sleighs, upon which there was no box, and the bunks of which were 8 feet 6 inches apart. The…
