INTRODUCTION

Plaintiff commenced this action alleging violations of her civil rights pursuant to 42 U.S.C. § 1983. Defendants County of Nassau (“Nassau County”), Thomas R. Su-ozzi (“Suozzi”), the Nassau County Legislature (the “Legislature”), and John P. Donnelly (“Donnelly”) have moved to dismiss the second and third counts of the complaint pursuant to Rule 12(b)(6) of the Federal Rules of Civil Procedure (“Fed. R.Civ.P.”) and, if granted, to dismiss the remaining state law claims for lack of jurisdiction pursuant to Fed.R.Civ.P. 12(b)(1). Defendant…
