On June 6, 1961, in the afternoon, the plaintiff was traveling in a westerly direction on Mack avenue in the city of Detroit. The defendant, Joseph H. Williams, a cab driver, was traveling in a northerly direction on Dubois and allegedly failed to stop at a stop sign for Mack avenue and consequently collided with the vehicle driven by the plaintiff. For the purposes of this appeal, the negligence of the defendant, Joseph H. Williams, is not disputed. The plaintiff was 55 years of age at the time and received injuries to his back, neck and leg.
