ROWLEY, President Judge:

Robert Taylor appeals from the order of the Court of Common Pleas of Philadelphia County denying the Writ of Certiorari which he filed after his conviction in the Municipal Court of Philadelphia County. He raises one issue in this appeal, namely, whether the charges against him should have been dismissed pursuant to Pa.R.Crim.P. 6013. After reviewing the record, we vacate the judgment of sentence and discharge appellant.
