MEMORANDUM OPINION

Plaintiffs have filed a complaint alleging that defendants Gruntal & Co., Incorporated (“Gruntal”) and Realquest Corporation of Westland, Inc. (“Realquest”) violated the Racketeer Influenced and Corrupt Organizations statute, 18 U.S.C. §§ 1961 et seq. (“RICO”), and Section 10(b) of the Securities Exchange Act of 1934, 15 U.S.C. § 78j(b). Plaintiffs also bring pendent state claims for common law fraud, breach of fiduciary duty and breach of the rules of the New York Stock Exchange (“NYSE”) and the National Association of Securities Dealers…
