The record in this appeal discloses that two eases, numbered, respectively, 7,402 and 7,403, commenced by appellees, Henry E. and Gottlieb A. Brudi, against' appellant herein and one Thomas E. Ellison were consolidated in the lower court and treated as a single case. On the issues joined upon the pleadings-of the parties there was a trial before a jury, and a verdict for $700 returned in favor of appellees against both of the aforesaid defendants.
