Ferguson, Judge:

Accused was tried by general court-martial and found guilty of rape, in violation of Uniform Code of Military Justice, Article 120, 10 USC § 920, and not guilty of desertion, in violation of Code, supra, Article 85, 10 USC § 885, but guilty of the lesser included offense of absence without leave, in violation of Code, supra, Article 86, 10 USC § 886. He was sentenced to dishonorable discharge, forfeiture of all pay and allowances, confinement at hard labor for five years, and reduction to the grade of Private (E-l).
