The accused was tried by a general court-martial and found guilty of two offenses, larceny and absence without leave, in violation of Articles 121 and 86, Uniform Code of Military Justice, 50 U. S. C. §§ 715 and 680, respectively. He was sentenced to a dishonorable discharge, total forfeitures and confinement for three years. The convening authority approved the findings and sentence. While the cause was pending before a board of review, a petition for a new trial was filed on the ground that a fraud was perpetrated on the court-martial. The board…
