MEMORANDUM OPINION AND ORDER

I. INTRODUCTION

This case comes before the Court after trial and on the parties’ post-trial proposed findings of fact and memoranda of law. The issue posed is whether the Boy Scouts of America properly may exclude from membership persons who are unwilling to profess a belief in and duty to a supreme being under Title II of the Civil Rights Act of 1964, which prohibits places of public accommodation from discriminating on the basis of religion.
