MEMORANDUM OPINION AND ORDER

This matter came before the court on cross-motions for summary judgment with respect to Count I of the TRUSTEE’S Complaint to avoid preferential transfers and the AMERICAN NATIONAL BANK AND TRUST COMPANY OF CHICAGO’S (“BANK”) motion to strike and dismiss Counts I through IY of the Complaint.
