MEMORANDUM ORDER
ERICRSON, United States Magistrate Judge.
I. Introduction
This matter came before the undersigned United States Magistrate Judge pursuant to the consent of the parties, as authorized by Title 28 U.S.C. § 686(e)(3), upon the Defendant’s Motion for Summary Judgment.
A Hearing on the Motion was held on January 25, 1996, at which time the Plaintiff appeared by John A. Fabian, Esq., and the Defendant appeared by Joseph W. Hammell, Esq.
For reasons which follow, we grant the Defendant’s Motion for Summary Judgment.
