Plaintiff-appellant Robert Curto, individually and d/b/a/ Curto’s Auto Service, (“Curto” or “Plaintiff”) appeals the summary judgment in favor of the Defendant-appellee the City of Harper Woods (“the City” or “Defendant”), whereby the District Court upheld the constitutionality of a zoning ordinance. The ordinance limits the number of vehicles which a service station may allow to be parked on the premises, regardless of the size of the parking lot.
