U.S. Home Corp. v. United States

United States Court of Federal Claims

1Opinion of the Court

OPINION

BUSH, Judge.

Before the court is defendant’s motion to dismiss plaintiffs’ amended complaint. Defendant relies on Rules 12(b)(1) and 12(b)(6) of the Rules of the United States Court of Federal Claims (RCFC). Oral argument *404was neither requested by the parties nor deemed necessary by the court. For the reasons set forth below, defendant’s RCFC 12(b)(1) motion is denied in part and granted in part, and the court defers ruling on defendant’s RCFC 12(b)(6) motion, which is converted to a motion for summary judgment.
