MEMORANDUM OPINION

TILLEY, District Judge.

Plaintiffs Alexander and Margie Ann Driggers (“Driggers”) filed a Complaint against the Defendants Sofamor, S.N.C., f/k/a Sofamor, S.A.; Sofamor, Inc.; and Sofamor Danek Group, Inc. (“Sofamor”) asserting claims for (1) fraudulent marketing; (2) negligent misrepresentation; (3) strict liability; (4) negligence; (5) negligence per se; (6) breach of implied warranty; and (7) loss of consortium.
