Dissenting Opinion.

Tremain, J.

—I regret my inability to agree with the majority of the court in a reversal of this cause. A study of the record is convincing that the appellant had a fair and impartial trial.

In presenting the question the majority opinion recites a statement of the facts presented to the lower court. The facts set out present the case most favorable toward appellant.
