GRAY, Circuit Judge.

This suit is brought for alleged infringement of letters patent No. 378,879, dated February 21, 1888, for a "filtering process for beer,” granted to Simon Uhlmann and Frederick Uhlmann, as assignees of Heinrich Stockheim, of Mannheim, Germany; application for same having been filed November 28, 1887. Complainant’s title to the patent accrued by a duly executed and recorded assignment. The patent describes and claims a process of finishing lager beer in completing it for the market, so as to take out therefrom the impurities and retain therein the carbonic acid gas. Mr.…
